A question I get a lot: “Broker Carla, I only have the tax declaration. How do I get it titled? How much will it cost?”
The story: Mang Lito’s lot in Batangas
Mang Lito and Aling Nena have lived on their lot in Batangas for more than 30 years. Mang Lito’s father planted the mango trees. Every year, they pay the amilyar at the municipal treasurer’s office, and the tax declaration is in Mang Lito’s name. When a buyer finally made an offer, the buyer’s bank asked one question: “Tax dec lang po? Walang titulo?” The sale stalled. (This is a dramatization; the names are fictional.)
The short answer
A tax declaration is not a title. But if the land is alienable and disposable (A&D) public land, and you and your predecessors have possessed it openly, continuously, exclusively and notoriously under a claim of ownership for at least 20 years, Republic Act No. 11573 (2021) gives you two routes to a title: an administrative free patent through the DENR, or judicial confirmation of title in court.
Tax declaration vs title: what the Supreme Court says
The Supreme Court has repeatedly held that tax declarations are not conclusive evidence of ownership, but they are at least proof that the holder has a claim of title over the property (Heirs of Ampil v. Manahan, G.R. No. 175990, Oct. 11, 2012). In Republic v. Belmonte, G.R. No. 197028 (Oct. 9, 2013), the Court called them “merely indicia of a claim of ownership.” So keep every tax declaration and every amilyar receipt. Together with other evidence, they help prove long possession.
The law: RA 11573 and your two routes
Route 1: Administrative free patent (DENR). RA 11573 amended Section 44 of the Public Land Act (C.A. 141). A natural-born Filipino who owns no more than 12 hectares, and who has continuously occupied and cultivated A&D agricultural land for at least 20 years (personally or through a predecessor) and paid the real estate tax, may apply for an agricultural free patent with the CENRO. For residential land, RA 10023 allows a residential free patent after at least 10 years of actual residence and continuous possession, within area limits: 200 sqm in highly urbanized cities, 500 sqm in other cities, 750 sqm in first and second class municipalities, and 1,000 sqm in other municipalities.
Route 2: Judicial confirmation of title (court). RA 11573 amended Section 14(1) of P.D. 1529. You file in the Regional Trial Court where the land is located, proving at least 20 years of open, continuous, exclusive and notorious possession of A&D land under a bona fide claim of ownership, for up to 12 hectares. Co-owners must apply jointly. The notice of initial hearing is published in the Official Gazette and a newspaper of general circulation.
The Supreme Court case: Republic v. Pasig Rizal Co., Inc.
In Republic v. Pasig Rizal Co., Inc., G.R. No. 213207, decided by the Court en banc on February 15, 2022, a company applied to register a 944-sqm lot in Pasig City that its predecessor had declared for taxes since the 1950s. The Court ruled that RA 11573 is a curative law that applies to land registration applications pending when it took effect, and that the 20-year possession rule replaced the old requirement of possession since June 12, 1945. But the Court also held that the DENR certifications submitted were not enough to prove the land was alienable and disposable. Under Section 7 of RA 11573, the proof is a certification signed by a designated DENR geodetic engineer, imprinted on the approved survey plan. The case was sent back to the Court of Appeals to receive that evidence.
The lesson: long possession helps, but you must also prove the land’s classification properly.
Step by step
- Check the land status. Confirm it is A&D land, not forest or timberland, and not already covered by a title or a pending registration case. Start with the DENR CENRO and the Registry of Deeds.
- Gather your proof of possession. All tax declarations (old and new), amilyar receipts, deeds or settlements showing how the land came to you, and affidavits of at least two disinterested neighbors.
- Secure an approved survey plan and technical description. A licensed geodetic engineer prepares the survey for DENR approval.
- Choose your route. CENRO free patent if you qualify, or a petition in the RTC with a lawyer.
- Follow through to registration. An approved patent is registered with the Registry of Deeds, which issues the certificate of title. A court decree is likewise registered for the title to issue.
How much will it cost?
I only publish figures I can verify. DENR filing fees for free patents are minimal; one DENR regional Citizen’s Charter lists an application fee of PHP 150 for agricultural and PHP 50 for residential free patents, plus documentary stamps. The bigger cost components are: the private geodetic survey; any unpaid real property tax; for the court route, filing fees, publication in the Official Gazette and a newspaper, and lawyer’s fees; and Registry of Deeds registration fees. Ask for written quotes before you start.
What this means for you
- A tax declaration alone will not satisfy most buyers or banks. Start the titling process before you sell.
- Keep every tax declaration and receipt. Gaps weaken your proof of continuous possession.
- Prove A&D status correctly. It is where many applications fail.
- Where to go: Municipal or City Assessor, DENR CENRO or PENRO, Regional Trial Court, and the Registry of Deeds.
FAQ
Can I sell land with only a tax declaration?
You can sell your rights, but the buyer takes on the risk and the titling work, and banks generally will not finance it. Expect a lower price.
Is there still a deadline to file?
Amended Section 48 of the Public Land Act allows judicial confirmation petitions to be filed “at any time,” and RA 11573 repealed the provision that set the old cutoff. Check with the CENRO or a lawyer for the rules that apply to your case.
What if my parents’ name is on the tax declaration?
Your parents’ possession can count toward the 20 years. You will need documents showing how the rights passed to you, such as an extrajudicial settlement among the heirs.
Is a free patent title as good as a regular title?
Once the patent is registered, the land is registered land under the Torrens system. RA 11573 also states that RA 11231, which removed restrictions on agricultural free patents, applies to patents issued under it.
